1. GENERAL

This Cookie Notice (“Notice”) is relevant to all users of the website and/or platform operated by VNX Global Ltd. (collectively “VNX Global”, “we”, “us” and their derivatives). This notice is provided for information purposes only and is not a binding contract. It is of general application and may apply to both customers and non-customers. For customers of VNX Global, the relevant VNX Global Terms and Conditions (as amended from time to time) which have been accepted by you in connection with your use of VNX Global services govern any access to, or use of, any services provided by us; and in the event of any conflict between the Terms and Conditions and this Notice, the Terms and Conditions will apply. VNX Global may, at its sole discretion, amend or modify this Notice from time to time by publishing an updated notice on its website. Capitalized terms that are used but not defined in this Notice have the meanings given in the Terms and Conditions.

This Notice should be read together with our Privacy Notice, which explains how we collect, use, disclose, retain and protect personal Information more generally.

The Site and Platform are operated by VNX Global Ltd., a Bermuda entity. This Cookie Notice does not constitute an offer or solicitation of services in any jurisdiction. We do not use targeting cookies to actively solicit clients in jurisdictions where this is not permitted. Where targeting cookies are used, they are used only where permitted by applicable law and, where required, subject to your cookie choices.

2. INTRODUCTION

When you visit or use the Site and/or the Platform, we may automatically collect certain technical information, including IP address, browser type, device information, operating system, date and time of access, pages viewed, and other log or usage information. Some of this information may qualify as Personal Information where it identifies, or can reasonably be linked to, an individual.

Our practices regarding the collection and processing of your personal information – when you visit and use the Site and/or the Platform (regardless of where you visit and use them from) – are set out in our Privacy Notice.

Please read the following carefully to understand how and why the Site and the Platform use your IP Address, cookies and other similar technical tools.

3. IP ADDRESS

3.1 What happens when you visit the Site?

Every time you connect to the internet or, if you use an always-on connection, such as broadband or ADSL, when you boot up or restart your computer, you are automatically assigned a unique identifying number known as an IP Address. This IP Address, which contains information regarding the location of your computer on the internet (your country of origin) and the name of your internet service provider (“ISP”), is automatically logged by the Site.

The same also applies when you access the Platform via the Site or otherwise.

3.2 What is an IP Address?

When you first started your internet session (i.e. your computer connected to the internet), your computer was automatically assigned a unique number (normally in the region of 9 or 10 decimal numbers), known as an IP Address. This is your computer’s unique address on the internet. Without an IP Address, websites would not be able to deliver their content to you given that they would not be able find your computer on the internet. Since each time you disconnect and reconnect to the internet a new IP Address is automatically assigned to your computer, IP Addresses are not inherently capable of identifying you as an individual (at least, by themselves and not combined with other identifiers). An IP Address does, however, contain information regarding the location of your computer on the internet (your country), and the name of your ISP, and which when combined with other available information may lead to your identification.

For these reasons, an IP Address may qualify as Personal Information where it identifies, or can reasonably be linked to, an individual. In some jurisdictions IP addresses may be treated as personal data.

3.3 How do we collect your IP Address?

Each time you visit a page on the Site or access the Platform, your computer sends out a message asking for the requested content to be delivered. This message sent by your computer also encloses your IP Address as a form of “return address”, so that the Site and/or the Platform may find your computer to send it that requested content. Our webserver automatically logs all these messages.

3.4 What do we do with your IP Address?

When we log your IP Address, the data collected is grouped up with the other logged IP Addresses in order to provide us with the statistics on the geographic location of visitors to the Site and/or the Platform, how long they stay on the Site and/or the Platform, which are the most viewed pages and for other statistical reasons that may be relevant for our business. We may also use your IP Address to confirm that you are eligible to access the Services and for other compliance-related reasons. These compliance-related reasons may include access controls, sanctions, eligibility, residency, geo-location and other regulatory or risk-management checks, where applicable.

We gather your IP address automatically and store it in log files. These files also contain information relating to your browser type, ISP, operating system, date/time stamp, clickstream data and the files viewed on Site and/or the Platform. Collecting this type of information allows us to generate aggregate information for the purposes of developing the Site and the Platform, including in terms of overall user trends and activities online (such as the number of unique visitors, pages accessed and viewed most frequently, or the search terms entered). Furthermore, it also allows us to administer the Site and the Platform, diagnose any potential server problems, analyze visitor trends and statistics, and generally helps us to provide you with better internet experience.

IP Addresses are not stored for longer than necessary for the above-mentioned purposes. Please refer to our Privacy Notice for further information on retention periods and other rights in relation to personal data.

4. COOKIES

4.1 What are cookies?

As is common practice with almost all professional websites the Site uses cookies, which are tiny files that are downloaded to your computer, to improve your experience. This page describes what information they gather, how we use it and why we sometimes need to store these cookies. We will also share how you can prevent these cookies from being stored, however this may downgrade or 'break' certain elements of the Site’s functionality.

Cookies contain information that is transferred to your computer’s hard drive. A cookie enables the Site to remember users that have already visited. Without a cookie, every time you open a new web page, the server where that page is stored will treat you like a completely new visitor. Cookies allow us to remember your custom preferences such as your language preference and allow you to complete tasks without having to re-enter your information when browsing.

4.2 How do we use cookies?

Depending on the type of cookie and applicable law, certain cookies may be used because they are necessary for the operation, security or functionality of the Site and/or Platform, while other cookies or similar technologies may be used only in accordance with your cookie choices.

We may use the following cookies:

  • (a) Strictly necessary cookies: These are cookies that are required for the operation of the Site and the Platform. Namely, by way of illustration, they include cookies that enable you to log into secure areas of the Site and the Platform and make use of certain functionalities (e.g. log-in and access to your personal account and portfolio on the Platform).

Because these cookies are necessary for the Site and/or Platform to function, they cannot usually be disabled through our cookie settings. You may disable them in your browser settings, but some parts of the Site or Platform may not work properly.

  • (b) Analytical and Performance cookies: These allow us to recognize and count the number of visitors and see how visitors move around the Site and the Platform when using it. This helps us to improve the way and manner in which the Site and the Platform work, such as by ensuring that users are finding what they are looking for in a seamless and straightforward manner.

  • (c) Functionality cookies: These are used to recognize you when you return to the Site and/or the Platform (as relevant). This enables us to personalize our content for you, greet you by name and remember your preferences set on the Site and/or the Platform (for example, your choice of language or region).
  • (d) Targeting cookies: These cookies record your visit to the Site and/or the Platform, the pages you have visited and the links you have followed. We may use this information, with respect to users in jurisdictions where this is permitted, to make the Site and the Platform, together with the advertising displayed on them, more relevant to your interests. We may also share information collected through such cookies with third-party service providers or partners for these purposes, where permitted by applicable law and, where required, subject to your cookie choices.
  • (e) Session cookies: These cookies contain encrypted information to allow our system to uniquely identify you while you are logged in. Session cookies exist only during an online session. They disappear from your computer when you close your browser software. These allow us to process your requests and help us make sure you are who you say you are after you have logged in.

Where technically available, we provide details of the cookies used, including their provider, purpose, category and duration, in our cookie settings tool or cookie list available on the Site and/or Platform.

4.4 How do I disable cookies?

You can prevent the setting of cookies by adjusting the settings on your browser.

You may also manage your cookie choices through our cookie settings tool, where available. You can control the use of cookies at the individual browser level and can even block or reject all or some cookies by activating the relevant setting on your browser. If you do block or reject cookies (including essential cookies), you may still be able to access and use the Site and/or Platform, but your ability to use some of their respective features and areas, together with the services that you connect to through them, may be limited or may simply not function properly. Be aware that disabling cookies will affect the functionality of this and many other websites that you visit. 4.5 Social Media Features and Widgets

The Site may include social media features. These features may collect your IP address and track which pages you are visiting on the Site. They may set a cookie to enable this feature to function properly.

Any personal information that you provide via such social media applications may be collected and used by other members of that social media application and such interactions are governed by the privacy policies of the companies that provide the application. We do not have control over, or responsibility for, those companies or their use of your information.

4.6 Third-party cookies

Please note that third parties (including advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical and performance cookies or targeting cookies.

5. OTHER INFORMATION STORED

For security and troubleshooting purposes our web server stores logs of activity on the website. The information stored includes date, time, IP, page visited, result, amount of data sent and browser used.
